A corte de apelos de IMIGRAÇÃO (BIA) negou a legalização de um imigrante através de casamento quando determinou que ele havia mentido em uma aplicação de asilo em 2000.
Em 2000 ele pediu asilo e mentiu em sua aplicação. Seu pedido foi negado e ele recebeu ordem de deportação em 2002.
Em 2012 a corte aceitou reabrir seu caso E ELE RETIROU O PEDIDO DE ASILO. Mesmo assim, de acordo com regulamentos, suas declarações no pedido de asilo foram consideradas e foi determinado que seu pedido em 2000 foi frívolo, barrando-o permanentemente de ajustar status/legalizar.

The BIA held that an untimely filed application for asylum may be found frivolous under INA §208(d)(6), and concluded that the respondent’s asylum application was frivolous because he deliberately made a false statement postdating his date of entry into the United States by more than two years, which is a material element in determining his eligibility to seek asylum given the general requirement to file the application within one year of the date of arrival.
